Please read these Terms of Service (“Terms”) carefully before using our website https://salud.gift/ (the “Site”) our mobile applications (the “App”), and any related services, products or content (all collectively referred to as “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Services for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Services without our prior written consent.
To access and use certain features of the Services, you may need to register for an account with us. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use, of your account or any other breach of security.
The Site and the App may allow you to submit or upload content, including but not limited to messages, photos, videos, and other materials (“User Content”). You are solely responsible for the User Content you submit or upload. By submitting or uploading User Content, you grant Salud Gift a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Services and Salud Gift’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
By providing us your phone number and email address and opting in to receive communications, you agree that we, including our affiliates, may contact you, including using autodialed or prerecorded message calls or text messages, to help you sign up and sign in securely, verify your identity, service your account and provide updates on sent and received gifts. You can decline to receive autodialed or prerecorded message calls or texts to the mobile phone number by replying STOP to a message from the phone number you wish to be opted-out from such messages or by sending an email to hello@salud.gift from the email associated with the account.
We collect and use your personal information in accordance with our Privacy Policy. By accessing or using the Services, you consent to the collection, use, and sharing of your personal information as described in our Privacy Policy.

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Salud, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We take the security of your personal information seriously and have implemented appropriate technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.
To the fullest extent permitted by applicable law, Salud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or (c) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Salud has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.
You agree to indemnify, defend, and hold harmless Salud, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third-party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your use of the Service, your violation of these Terms of Service, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity.
These Terms of Service and any action related thereto will be governed by the laws of the State of Delaware without regard to its conflict of law provisions. You agree that any dispute or claim arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation or validity thereof or the use of the Service (collectively, "Disputes") will be settled by binding arbitration between you and Salud, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our product, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our product (or any part thereof).
We may update these terms from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
Salud charges a fee of 3% of gifted value to cover card processing fees.
Refund Policy: If the receiver is unable to redeem the gift because they are under 18, don’t have an iPhone, are unable to pass identity verification during sign up or are unable to activate their Salud Card, you may request a refund by contacting us. The amount charged excluding the processing fee will be refunded within 5 business days.

Your use of the Salud Card is governed by the Cardholder Agreement which includes the Patriot Bank Privacy Policy, and the Apto Payments Privacy Policy. Salud is a “Program Partner” of Apto Payments for the purposes of the Cardholder Agreement. The card funding method available with your Salud Card (the “Funding Sources”) is by charging an external debit or credit card.
